ExpiredSubmission: Review of the ACNC Act

The Federal Government has released terms of reference for the review of the Australian Charities and Not-for-profits Commission Act 2012 and the Australian Charities and Not-for-profits Commission (Consequential and Transitional) Act 2012(ACNC)Under the legislation, the Government must conduct a review of both Acts after their first five years of operation. The terms of reference and information about the review are available here.

ACOSS will make a submission to the review and TasCOSS is seeking your input, which we will feed into the ACOSS submission.

We would like your responses by COB Tuesday 30 January (and we apologise for the short notice).

The Review Panel will inquire into and make recommendations on whether the ACNC Acts are doing what they are intended to do, being:

  1. to maintain, protect and enhance public trust and confidence in the Australian not-for-profit sector;
  2. to support and sustain a robust, vibrant, independent and innovative Australian not-for-profit sector; and
  3. to promote the reduction of unnecessary regulatory obligations on the Australian not-for-profit sector.

The Terms of Reference provide some guiding questions which might be useful for framing your response (scroll down the page to find them).

The ACNC has already made a submission to the review, which is attached to this email. It proposes controversial changes to the objects of the Act. The proposed new objects are:
(a) To promote the effective use of the resources of not-for-profit entities; and
(b) To enhance the accountability of not-for-profit entities to donors, beneficiaries and the public.

These proposed objects would increase the power of the ACNC and its Commissioner to determine a charity’s effectiveness and impose greater reporting requirements. In short, the ACNC would cease being a regulator and act as a judge of how not for profits use their resources.
